Terms and Conditions
These Terms & Conditions of Sale (“Terms”) govern the purchase and sale of food products marketed under the brand Bubbles, including Ogi products (“Products”), by Bubbles From Bedford Limited, a corporation incorporated under the laws of Canada (“Bubbles”, “we”, “us” or “our”).

If you are a resident of Quebec, additional rights may apply under the Consumer Protection Act (Quebec) as set out in Section 20 below.
2.1 All Orders are subject to availability and acceptance by Bubbles.

3.1 All prices are listed in Canadian Dollars (CAD) and exclude applicable federal and provincial taxes unless otherwise stated.

3.5 Commercial Customers are subject to agreed written payment terms. In the absence of such agreement, payment is due Net 30 days from invoice date.
3.6 Overdue accounts may incur interest at 2% per month (24% annually) or the maximum permitted by law.
4.1 Orders are dispatched once per week on Mondays only (excluding statutory holidays).
4.2 Orders received after 4pm on Friday will be dispatched the following Monday.
4.3 We aim for delivery within approximately two (2) business days following dispatch. However:

6.3 Bubbles reserves the right to cancel any Order prior to dispatch at its sole discretion.
7.1 Customers must store Products in accordance with packaging instructions.
7.2 Bubbles shall not be liable for spoilage, contamination, or degradation caused by improper storage after delivery.
8.1 Commercial Customers purchasing Products for resale must enter into a separate Wholesale or Distributor Agreement with Bubbles.
8.2 In the event of a conflict between these Terms and a signed Wholesale or Distributor Agreement, the signed agreement shall prevail.

9.1 Products purchased through our website are intended for personal use only unless expressly authorised in writing.
9.2 Bubbles reserves the right, in its sole discretion, to cancel any Order that appears to be placed for resale purposes.
9.3 This policy is intended to help ensure Products remain available at our best prices for our customers.
9.4 Indicators of resale activity may include bulk purchases, repeated high-volume orders, or use of freight forwarding services.
All trademarks, logos, branding, packaging design, and marketing materials are the exclusive property of Bubbles From Bedford Limited.
No rights are granted except as expressly set out in writing.
11.1 Products are provided “as is” except as required under applicable consumer protection laws.
11.2 To the fullest extent permitted by law, we disclaim all implied warranties not expressly required by statute.

We shall not be liable for delay or failure to perform obligations due to events beyond our reasonable control, including natural disasters, supply chain disruptions, government actions, labour disputes, or transportation interruptions.

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, except where Quebec mandatory consumer protections apply.
We may amend these Terms at any time by posting updated Terms on our website. The version in effect at the time of purchase shall apply.
If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with any applicable Wholesale or Distributor Agreement, constitute the entire agreement governing the purchase of Products and supersede prior representations or agreements.
